SSDS Wins Reinstatement of Improperly-Terminated Teachers

On September 27, 2016, Los Angeles Superior Court Judge James C. Chalfant issued an order requiring the William S. Hart Union High School District to reinstate two long-term ROTC instructors that the District summarily terminated in violation of the California Education Code. Although the two teachers worked for the District for 20 and 11 years, respectively, and had attained permanent status, the District decided in June 2015 to retroactively change their status from “permanent” to “probationary” so that it could terminate their employment without a hearing. Judge Chalfant ruled that the District could not lawfully treat the teachers as probationary employees, because it failed to notify the teachers before they began working of its intent to employ them with non-tenure-track status.
