We represent many employee pension and welfare benefit plans, primarily trust funds jointly managed by union and company representatives. We advise trust funds regarding compliance issues under the Employee Retirement Income Security Act (“ERISA”), COBRA, HIPAA, the Internal Revenue Code, and other state and federal statutes and have represented trustees in arbitrations over plan administration. We draft plans and trust agreements, represent plans during DOL and IRS investigative or full audits, qualify plans for tax-exempt status, and draft agreements with banks, investment managers, health care providers, third-party administrators, consultants, and other plan providers.

We also represent benefit plans and individual participants and beneficiaries in all forms of litigation under ERISA, including suits to obtain benefits, collect contributions or withdrawal liability, or challenge misuse of plan assets.
